Dd Form 441 Security Agreement

Once your company is sponsored for an FCL, the Industrial Safety Representative is assigned by the DSS to help you meet NISPOM requirements. The DD 441 is a simple two-page form with a few self-declared fields: DD Form 441, Department of Defense Security Agreement, is an intermediate contract form signed between the U.S. government and a contractor. The department issuing the form – sometimes mistakenly referred to as Form DA 441 – is the Department of Defense (DoD). The last revision of the document was published on 1 February 2020. Form DD 441 is implemented at the time of approval of the release of the facility and is considered a legally binding document between the U.S. government and the contractor. By signing this document, you agree to implement a safety program and meet the safety requirements outlined in the National Industrial Security Program (NISPOM). Running the form allows your organization to work on the classified contract.

It also allows the federal government to review the safety program you have in place to ensure it complies with rules and regulations. Where an entity needs to have access to the national security information necessary to enter into a contract or respond to a request, it must first obtain a Security of Facility Guarantee (FCL). The FCL is granted if the federal government finds that access to classified information, secret or strictly secret to your company is in the interest of national security. You cannot apply for an FCL on your own account. It is necessary that the classified contract is awarded to your company by a federal authority or by a company that has already received its FCL. The form DD 441-1, annexed to the Ministry of Defense Security Agreement, is an annex to the DoD Security Agreement. It contains a list of departments and branches covered by the Main Security Agreement and Standard Form 328, Certificate Pertaining to Foreign Interests. If your company is a division or branch of a company that has already received an FCL, your company will be included in the security agreement signed by the Home Office company.
