In essence, a waiver eliminates actual or potential liability for the other party in the agreement. As a general rule, the abandonment of the law means that the contractor loses the right to assert a right contrary to the contract. This results in the loss of claims for damages and other remedies that may be available. (a) No general waiver. The failure of a party to demand at any time the performance of a provision or to have recourse to an appeal under this Agreement shall not affect the right of that party to demand the performance or, at any time, to appeal thereafter, and the waiver of an infringement by a party shall not be considered a waiver of a subsequent infringement.
